Legal Question in Family Law in India
Dear Lawyers,
I got separated from my husband due to extreme domestic violence in January 2015. I filed DV and dowry case against him in July 2015 and he filed a contested divorce case against me in August 2015.
Now, if I want to close the cases at the earliest - what should be the quickest and most convenient way out? Should I file for mutual consent divorce with his consent (but we do not have any cordial relationship/ communication channel, and am not sure if he will now agree to file a MCD application) or should I just not appear in the court and go for an ex-parte decree or if there is another, better way-out?
I have no expectations/ greed for alimony or maintenance - I am fairly independent to sustain myself. I had filed cases to bring him to justice for his actual wrongdoings - but I don't see any action being taken against him, despite all the proofs. So now all I want is to close all the cases (primarily the divorce case) in a hassle free manner and start life afresh.
Please suggest all the possible solutions to this - what are their pros and cons, and approximately how much time and effort should each take.
