Legal Question in Family Law in India

Dear Sir

My Niece is having a girl child of 9 years and now being 2nd marriage , married to a gentleman who is also having a biological Son of 8 Years thru his earlier marriage. They wud like to Change the Surname and Fathers name in Girl Child ( my Niece daughter) in her Birth Certificate. Pl suggest a solution on procedure to proceed further

Your niece must have the custody. Secondly, the second husband has to execute an adoption deed for the same.
