Legal Question in Family Law in India

Dear sir,

one of my friend (Female ) has got married in the year 2008 .Later on she found that her husband was started troubling form there on . He was troubling her like anything and she also have girl baby with her now . Few years after marriage she got separated from her husband . she doesn't have any kind of proof for their marriage . Now she wants to marry some one , so we would like ask that whether she wants to apply for divorce from her first husband or she can marry without any divorce ?

Suppose if she apply for divorce , how many days it will take for divorce case? Your favorable reply would be appreciated .

dear client she have to apply for divorce on the ground of desertion and cruelty. it will take one or two years to get divorce. if she will marry without divorce then her husband can file case of bigamy against her and if case prove then she will be punish for five years jail. for any legal help call me
