Legal Question in Family Law in India

my family is this christian - father -dead 3yrs before;

mother- married another man 1yr before & not giving house property documents to us & no pre written doc by father ,

childrens [ 2 boys - am the younger] ; both - married ;

my age -29 yrs , brother 32 .

please advice , ...

we both children are residing in another locality and this property - house is rented & this rent also taken by [ before mother] , should i file a case against her , and will she get A share of property.

if there i no will then all legal heirs have equal rights

which part of india you belong to? you need to consult a lawyer in person along with all the documents as it needs to be seen whether the property is self acquired or joint.
