Legal Question in Family Law in India
The family court has passed divorce order. It is now pending in high court. The couple are staying separate for last 4yrs.. divorce was filed by husband after 1yr of marriag on grounds of cruelty. The wife is unwilling for mutual divorce and is now intent on dragging the case only for revenge. My query is...is it possible for the court to grant final order on divorce and continue the case on other points regarding maintenance etc. There are no children involved n d man wishes 2 remarry.

maintenance case is different , if he is paying maintenance in divorce case u/s 24 then court can pronounce the order as per facts of the case
