I have filed 498A against my husband and his mother...Now he is ready to pay some money for the cruelities he has done on me and the child but the amount is only petty while he is a multi millionaire...can I ask for partition in his HUF property for myself and my kid??? or should I compromise with the little money that he is giving and take the burden of bringing up the child completely on me???

If he is a millionaire, the maintenance should be such that you and your child should live life comfortably for rest of the life. You don't have any property rights as of now and hence you can't claim partition. If he has certain ancestral property, your child can claim his share.

Dear client u cannot ask share in property but u can ask share in the name of child in the huf. As he is financially sound u can ask monthly maintenance for u and child by filling case under sec 125 of criminal procedure code. For any legal help call me on 9422611385
