Legal Question in Family Law in India

I filed case against my husband for domestic violence n maintenance. I want to ask about my house. House is in my name but husband is paying all installments. My father paid him 10 lakh cash without anything in writing and asked him to purchase home in my name. But now husband is saying because I m paying installment from my account so house is mine. But why if the property is in my name. Plz suggest. We both r living together but he is asking me to leave with children n we want him to leave because house is in my name. Plz show me the path n truth that who will get the house.

as the house is in your name there is no problem, only thing is not to leave the possession, further as you both are living together, as he is paying the installment there is nothing wrong as it is his duty to provide house, further proceed with the domestic violence case and in that case you can get protection orders that he should not forcibly evict you without due process of law, further even if the house was in his name the law will not help him and ask you to evict as you have a legal right to reside in husband's house.
