Hi, I have filed Protection of Woman from Domestic Violence (PWDC) act 2005, against my inlaws and husband from which iam living seperately with my parents , he had filed rcr case with conditions to which i didnt respond due to unavoidabe situations dont know what he has done with it. I have filed 498a in his city and PWDV in my city , in that my lawyer suggested me to file intrim mainetnance. I am well educated was working before marriage but now dont have any income source and financially dependent on my aged parents still searching for job but the job profile i was working now demands pg degree which iam pursuing after completion there are possibilities to get job but till then iam helpless struggling for daily needs so i was looking for monetaory relief from my husband as he has yet nt given divorce nor paying attention to me...the court had issued summons but they are not found because the house was locked when protection officer tried to contact them through cell no but he and his lawyer not ready to accept the courts summons though protection officer warned them of consequences they said you can do whatever you want but we will not accept the summons ....iam seeing my efforts fruitless kindly suggest me a way to get my rights.

1) If he is avoiding to receive summons, the court will complete service as prescribed
and pass ex-parte orders as deem fit and proper which will be binding on him.
2) Ask ur lawyer to expedite the process and bring the facts to the notice of the court.
3) Find out what happened to the RCR which is not binding on u, but may go in his favor.
4) U hv all legal rights to fight ur case and ur efforts are not fruitless.
Better to consult your lawyer, advocates have all ways out.
got ex-parte order and file execution and attach his property and salary etc.
