Legal Question in Family Law in Pakistan
A friend of mine's wife had extra marital affairs and last month she ran away from him taking a minor son along with her. Most of her online conversations and cam chats are recorded to prove her bad character.
Now my friend does not care about his wife return but only about his son. His wife is sending him a divorce notice soon on the basis of miss treatment etc and would definitely apply for child's custody. What options does he have in order to secure the custody of his son.
Family lived in Kuwait, and the wife ran away to Pakistan without the knowledge of her husband, also stole his passport so he could not trace her.
Husband is a well earned man and provided every luxury of life to his wife.
Please explain in details and mainly to get this son custody !

You friend can file a case for the custody of his minor son. And all the record he has would be beneficial for him to proof the bad character of his wife. Husband has to file custody petition.court decides such petition based on welfare of child. Welfare of child itself is assessed on number of factors such as financial condition of mother or father,second marriage, character of mother or father, wishes of child , age of child,so on and so forth.
