Legal Question in Family Law in United Arab Emirates

It would a great help if you could advice me on the below matter.

I am a Muslim, Indian residing in Abu Dhabi, UAE. I have two children, a boy aged 7 and a girl aged 9 months, My husband has repeated cheated on me, He doesn't give me any financial help except for the kids - for which I have to fight for. We have been having fights and issues since a long time but my family pushed me to stay in the marriage at the beginning and now I am staying in the marriage for my kids. Recently he has been making more and more issues and also making stories about me in a bad lights and telling it to every one. He was saying that he want to divorce me but then he realized that he will have to pay me so now he is quite about that but is starting to picture me in a bad light.

I have had enough and I really would like to file for divorce.

What I want to know is what is the difference when a woman files for divorce? And most importantly who will get child custody?

The most important thing is that I want my children to be with me. Could you please advice me on what stance I should take?

About three years back he took the money equivalent of the mehr (dowry) and also the gold he has bought for me since marriage, from my father. Also,my father lent him a large sum of money to start business last year. There was no proof and now he has no intention of returning it. Is there any thing that can be done about that?

Please help with with your advice. Which law would be favorable for me to get child custody? Shariah law or Indian law?

First, you can claim divorce because your husband doesn't support you. Second, Witness statement can be used as evidence regarding the money that your father lent him.

As per Sharia Law you can keep the custody till the age of 11 for your Boy and 13 for the girl. Sharia Laws would be your best option.
