how can i take guardianship o my daughter (8 years)
took khula from court on 12 march 2011
daughter was with me
my ex husband did not appear at court.
now i want to move abroad but there is requirement of guardianship
my ex husband didnt perse the khula case
how can i take guardianship of my baby ( 8 Y).husband didnt single penny on account of naan nafqa n child expense .
court him to pay monthly amount for daughter ....
i m ed up of irresponsible behaviour o him.
how much time will take for gurdian ship..its mention in decree that baby girl is with mother

You have a file a petiton before guradian court through a lawyer for gurdianship. we can manged it to get it within 02 months , if not contested by her father. Dont claim any miantenace in future otherwise he may contest your petition for gurdianship.

you can get guardianship certificate by filing a petition for the custody. The only thing which is to be considered by the court is welfare of the minor and if your ex husband is not paying you the maintenance which was fixed/directed by the court then your case is very strong and his irresponsible behavior will help you to get the custody easily.

yes u can file petition for guardianship, minor being daughter, in safe hands and irresponsible behavior of ex-husband would favors u, it will take time about atleast 3 months in case father of minor never contested the petition other wise about 06 months to 09 months time will be required.
