sir,

my husband financed a house from icici bank in 2006 named by my mother-in-law.he payed all installment continue but now my mother-in-law don't want to transfer the house my husband name now what we can do pls suggest me.and she has a tenat last 6years and rental income she take.na hi makaan khali kara rahi hi jabki unka khud ka 1 makan aur hi jisme bo rah rahi hi.

Dear client,

Actually speaking the house belong to your Mother in Law legally and even if your husband had invested money and paid the instalments he is having NO right over the property. Since the property is in her name she can rent it out and collect rent. From the question it seems that you are having acute shortage of space,for that ask your husbamd to talk to his mother coolly and stop the practice of giving for rent. It seems that it is better to keep silent on your side is the best idea. Once you become silent your mother in law will assign the propeety in your husbands name. In real.sense your mother in law is afraid of you that is why she is keeping the property in her name and the rent is used for hwer expenses. Ifur both of you give assurance about steady monthly income equalent or above the income obtained by way of rent by depositing fixed deposit in her name, she may agree to tramsfer the property in your husbands name. legally she is the owner and she can receive rent.
