Hi,

first time I am using this web site so not sure it's of any use.

I have posted one question one week back. I haven't received any reply. So sending you same query again. Me and my husband are thinking of separation. We have been married for 3.5 years. Our marriage was in India but I would like to file divorce in Australia. My husband is Australian Citizen and I am Australian permanent resident(green card holder). After marriage I was working and my money was used for paying off his loan. It was also used for his family. Other than that I have gone through really bad time. I would like to get compensation for that.

My husband doesn't want to file divorce in Australia since he thinks he might escape from compensation in India.

What do you suggest I can do?

What can I do if he files divorce in India and I don't want to file it in India.

What heppens if I file it in australia before he files it in India.

If Australian court decides to give me compensation then my husband can challange it in India?

Is your your Husband a NRI ? Indian born Australian Citizen. The answer to this question is relevant for your Divorce and subsequent Alimony etc. You will get more compensation /Alimony + interim maintenance if your answer is yes that your Husband is N.R.I.
