Legal Question in Family Law in India

Hi,
I am going through DV and 125 and my wife took my passport and not ready to give back.Can I apply for reissue passport stating that it is lost.
Can I mentioned for below two points in passport application
1) Have you ever been charged with criminal proceedings or any arrest warrant/ summon pending
before a court of India?
2) Have you at any time during the period of 5 years immediately preceding the date of this application
been convicted by a court in India for any criminal offence and sentenced to imprisonment for two
years or more?

1) No. When the facts are otherwise, u cannot say it lost. U hv to submit copy of FIR

and the progress of the case. U will be prosecuted for making wrong declaration.

2) Now-a-days Police will seriously investigate as the lost Passport might have fallen in

Terrorists hands.

3) Hv u lodged FIR with the Police? After u complain if wife says u made false complaint

u will be proved lying inferred in DV cases also.

4) Other points u have to respond as per facts.
