Legal Question in Family Law in India

Hi,

I am married since Dec 2013 and have a daughter. My wife and I are having issues since last 9 months or 10. Four times she has gone to her parents place on her own with them for the reasons that I shall leave my family (mother and two brothers) and live with her and a few other like those. Her family threatens me to put me behind bars etc..

Never been a scene for any violence, dowry or nothing.

Now, she wants to come back to me but she is still acting the same way and talking to me the same way and I have reached to an extent that I do not even want to see her face.

I want to get divorced because these situations are beyond control to get sorted out via conversation and would stay the same way all life long. I do not want to live in depression.

I earn around 30k per month and have two motorcycle loans 6.5k per month.

I do not have any other or parental property in my name.

My wife is not employed.

She won't be ready to get divorced, but I do need it to live happily.

1- What my options are to get divorced?

2- Would there be any maintenance charges for her to be paid by me? If so, how much?

3- I do not want the custody of the child as well. What about the same?

4- What else must I know about these things?

Dear client u can file divorce petition on the ground of cruelty against wife. But she can file maintenance case for her and child. As she is unemployed so court can order u to pay maintenance to them. Maintenance will around 25% to 50% of yr monthly income. For proper discussion call me on 9422611385 or 8446247807
