Legal Question in Family Law in India

I am Hindu from Noida and my wife is Jain from Pune. Our marriage got registered under Maharastra Regulation of marriage Bureau and Registration of Marriage Act 1998. We got marriage 7 years before and we have a girl kid of 4 years. She is going to school. My wife is not agree for mutual concent divorce, hence want to file divorce petition on cruelty basis.

I would like to know:

1. Under which act I can file the divorce petition

2. Is our marriage is legal. I am hindu and she is Jain hence not legal in Hindu marriage act, I think.

3. what precautions should I take before filling the petition.

4. Any other suggestion in order to came out safely and quickly.
