My husband is cheating me and he is an affair. I have been trying for so many years to make him change. But he does not change. I am not able to tolerate that when he beat me and in recent past days he choked my neck using my duppatta, pressed by mouth using his hand where i was unable to breath. I have a girl child and now I have decided to go for legal separation. I would like to know about the child custody and what is the atmost rights he has as a father. Is he have rights to see my daughter everyday and dont have the possibility to go anywhere out of town/city/country. Wherever I go, he will come and shout and beat me. My child is affecting because of his behaviour. Is there any possibility to make him avoid to see my daughter. Please help.

if you hold the evidence of such a torture, then, in case of separation, he will not be able to get the custody of the child. You have not mentioned the age of child. Normally, also, girl child custody remains with the mother. Did you file police complaint of the incident of your choking. he will be under obligation for child maintenance without child custody. You have not mentioned whether you are working or not.
