Legal Question in Family Law in India
My husband left to Dubai without any information to me. He did not even come to see our new born Baby nor has he seen him till date he is 7 years now.I filled an 498a( pending) and domestic violence case against him 5 years back.
My husband was employed in Dubai and stayed there for 4 1/2 years. No details of his employment are available with me. He came to India after a NBW was issued against him, before receiving it. He worked at some place in India and did not disclose it to the court. He has left his job and sitting ideal at home now.
In DV case, the judgement has been passed in which it is proved that the Domestic violence has happened. And In residence order 8000/-pm for rent has been passed only and no maintenance order has been passed because i have not submitted his salary details.My husband has also executed an release deed on his immovable property in favor of his father.
- Is it necessary for me to submit his proof of salary details in appeal?
- Can the court not consider the above facts or any case law?
- Any case law or suggestion?

the court could direct him to file his salary certificate and the bank statement for the last three years. refer to Puneet Kaur vs Inderjit Singh Sawhney on 12 September, 2011 to clarify the issue.
