The case of aduletry can be filed against a person who knows at the time of relationship that you are married with some person and who is alive. You can only be sued as an abettor but no punishment can be accorded to you. The person with whom you may be staying may also be discharged in case if he proves that he doesn't know whether your husband was alive at that time.
