My husband provided false information and took away my daughter to USA. He told us that a short visit to inlaws and back and absconding since then. He called from US after 2 months and told he deliberately lied to get my daughter. she is 5 yr old and I miss her, Its me who raised her with my parents moral support. me and my husband are separated but not divorced yet. Please give me a right path to get her back to me ASAP. This is my situation.
1. He is proceeding legally in USA for divorce and child custody
2. I filed FIR here and Child custody
I doubt how long i takes in Indian court. my daughter is not happy there and I cant live without her . for her family is me , my parents n brother.
kindly suggest best way to get her back. If i go to usa to argue my case there i am afraid he will do anything to me to get to keep myd aughter, in the summons he is NOT evengiving me equal child custody. So the US judgement is valid in India?
I want to go to US and get the hearing of the case but can I continue the case in India and still go to US and see my chances.
Please suggest a best way to get her back ASAP. I cant imagine loosing my daughter and my husband is not a nice person he has a criminal mindset

1) The US divorce and child custody is not binding on u. U should not go to
US and contest. Ex-pare divorce in US is not valid in India.
2) Five DV, 498A, 125 CrPc cases and follow-up with child custody in India.
3) If he is not responding to ur summons, Police will issue Look Out Circular
by following due procedure.
4) Engage a able experienced competent advocate to deal effectively.
5) U should not receive US summons and avoid but move India courts.
6) The verdict of Indian Courts are valid in US in view of Hindu Marriage Act, 1955.
