Legal Question in Family Law in India
Hi Iam 30 years old and have been married for seven years. I have a 3.6 yrs old daughter and now I have discovered that I am 6 weeks pregnant. I have an MBA degree and was working before my first child was born and then gave up work as my husband wanted me to take care of the baby full time. As time has passed there have been a lot discords and fights amongst us and I really feel that there is a need to separate our ways. We r currently in Dubai. I want to know that according to Indian court of law where do I need to file the application for divorce and how will I get the custody of my daughter. Lot many people on my husband's side are lawyers so I feel maybe he can try every mean out to take custody of my daughter. I need the detailed advice.

Since you both are in Dubai you can file your divorce at Dubai it self...........
just you need to get the judgement copy attached via Indian Ambessay at Dubai .... a long way to go ......
Since your daughter is too small so 95% chances are that you shall get her custody......need not be worried how many lawyers your husband may hire but the fact is have faith in God and belief in Justice ........

1) U may obtain divorce decree in Dubai and file the same in India court. If ex-parte decree, India courts will not accept. U r governed by Hindu or Muslim personal law is not clear.
2) U can file child custody case. Since the child is daughter and below 5 years age, chances are bright.
