This is in India. I filed 498a, 34 IPC and Domestic Violence Act'2005 against my husband and his family. It is a true case and having documentary evidence. And my husband filed divorce petition on false ground. I am working, getting Rs. 15000/- per month and my husband getting Rs.35000/-per month and his parents are having own property. Advocates are telling that i will not get any single money by the court and it will take so much time, so take divorce mutually and withdraw all cases. I think all persons(Governmental, Adv.)are interested to make divorce and charging heavy fee including councellor. Always councellor woked for making dovorce only. Since 1 year i was telling her that i am ready to live with them. Now the question is If i take divorce by court then what amount (including my stridhan which is safe in bank locker) i will get from the court and how much time it will take? My husband's advocates are making fool them and they are doing more crimes by taking suggestions from advocates, think so. Also, guide me to take decision. Hoping URGENT REPLY due to 2marrow is the final decision. Thanking you.

It is your prerogative to give or withhold your consent for divorce. However, he may pursue his remedy if the grounds for divorce are covered within the statute. Meanwhile, you should accept return of your istridhan. The time taken in court proceedings cannot be anticipated.
