Legal Question in Family Law in India
I am indian citizen n living in india currently.I have violence restraining orders against my husband.We have been married for past eleven yrs.He has been emotionally abusive and had extramarital affairs too.He isn't moving back to india now and neither agreeable for mutual divorce. The violence restraining orders that i have are granted to me by Australian family law courts.My confusion is on how to get divorce in Indian courts.Husband has always threatened that he will use indian hindu marriage act to harass me and never mutually agree for it. How to start the application for divorce n what to expect during proceedings?I just wish freedom from abuse n want divorce ASAP.Its been more than a year that we are leading separate lives.

It is a typical condition and should be handled with utmost care else you will not get decree of divorce so easily and it may go for 7-10 years. even then you may or may not get divorce. So you have to take step by step and i think you may get divorce within few months or within a year. Better to engage any expert lawyer.
