The Infancy Act refers to custody. Also Guyana follows English common law cases. Both parents are entitled to custody of a child, but where there is a dispute, the Court will take the welfare and best interests of the child into account by considering all the facts put to the Court. A mother's husband with a conviction of carnal knowledge would certainly be relevant especially in relation to custody of a young girl.
