This depends on the age of the children and even gender. All children of tender age generally stay with their mother unless there are special circumstances that adversely affect the children if they remain with their mother. The father will still have access to the children.

As the children grow older, they still generally would remain in the custody of their mother, particularly if they re female. However, at this point, the law would consider JOINT custody, which means that the children get to spend time with both parents.
