A lawyer sent me a legal notice of defamation on behalf of his client. Client is a lady who has extra marital affair with my father. She has sent notice of defamation against my mother and i know (daughter) that whatever was written in the notice was truely false and on behalf of all those false statements she asked my mother to give her compensation within 15days the notice sent on 27th february 2014. The notice was sent by a lawyer not through court. Only an application against domestic violence has been given to local police station by my mother and nothing else. That client havn't prooved anything that how my mother defamed her. What actions will be taken if my mother refused to pay the money within 15 days or didn't reply to that notice? What action we can take against her of sending false notices to my mother?

Defamation is most difficult to prove. See the world. She has an illicit relationship with your father and she is sending the notice for defamation. Firstly, defamation can't sustain on the premise that a complaint under D.V.Act has been filed. Secondly, D.V.Act can only be filed against your father not against the lady.The fact is that your mother has lots of rights and options and she can ruin them both. Call me for assistance. Please contact with the notice for preparing a reply to the notice. You are not recommended to pay any money unless the contents of the notice is examined by a lawyer. Defamation is extremely difficult to prove, however it would not stop them from filing a suit in Civil court or a complaint in Criminal Court.
