Legal Question in Family Law in India

I have learnt from P Patel that if husband does not appear for hearing of RCR the the court will dismiss his case.

Now I would like to know that can he files the divorce case again?

Coz i apprehend that he might do so secretly just to get ex-parte.

n.b: he has not complied with the maintenance order.

Defence of husband can be struck off for non-payment of maintenance ordered by the court. An ex parte decree cannot be passed if you have been 'served' and you are appearing.
