Legal Question in Family Law in India
Living separately for the last 10 years since 2005. I filled a divorce case in 2008 but got dismissed as I could not prove the grounds of mental cruelty and dissertion. However, ground of dissertion was not taken up properly by the lawyer.
In 2011 she moved to women cell, which recorded the following statements in its facts & finding report:
1. Both are living separately for the last 7 years.
2. Husband is willing to join her in rental accommodation.
3. Wife is not willing to join in rental accommodation and is insisting to live only in her in-laws house.
4. It appears to be a property matter.
5. no dowry has been demanded and no harassment has been done.
Three years have since then and my wife is still not living with me and in total we are putting up separately for the last 10 years. Is there any chances of getting a divorce?

1) If u can prove she is not living with u for the last 10 years
will be the ground for divorce and move afresh.
2) If it is the property matter better sort it amicably and
get out of the whole episode.
