Before their marriage riya was working as a principal of a public school in delhi while her husband manish was an officer in bank at kanpur. At the time of solemnisation of marriage the parties did not discuss about the location of matrimonial home. After marriage manish wanted riya to resign her job and join him. On her refusal he filed a petition for restitution of conjungal rights. Decide.

Living apart for employment purpose in given circumstances is neither separation nor it amount to desertion. Petition for restitution of conjugal rights is not maintainable. Filing of restitution of conjugal rights is a wastage of time and money and raise other legal complications.
