Legal Question in Family Law in India

Hi, I am married in 2009 and my marriage is still not consumated as my wife is not cooperating. We have applied for mutual consent divorce in 2011 Feb. However during the second motion i was not available as i was Abroad and could not come and case got cancelled.

Again we started staying together with mutual understanding with each other however still the same problem where my wife is not cooperating. Unable to bear this i came out of the house and staying seperately now. My wife also does not wear Mangalsutra and also she did not disclose to anyone at her office that she is married. Only 2-3 people in her office know that she is married.

Both me and my wife are working. Now my question are as below,

1) How can apply for divorce.

2) Can she raise any 498 against me.

What all cases can and what all can me do against me in the worst case. She is nont in speaking terms for any Mutual consent divorce.

How to get rid of this thing as it is causing me mental pressure due to which i tried to commit suicide once.

divorce by mutual consent is the best option available to you both. however, if your wife is not ready, you can make efforts to convince her for the same. you can also seek help of elders of both families in this case.
