Legal Question in Family Law in India
I got married in 2004 and suffered at the hands of my wife who used to abuse my parents and used to stay with her parents for long periods. I had to file for the restoration of conjugal rights and after the restoration of rights too, when things did not improve and my wife tried to register false dowry complaints with police, I filed for divorce. I was granted divorce by lower court in 2012. But she has gone to high court, which sent it across for mediation in the first go where the financial discussions failed. And she has gone back to the court with the same insistence that she wishes to go back.
During the marriage we had a child too (during the 9 months of matrimony too she stayed away at her parents place).
The question that I have is that in case I file a child custody case and she gives me the custody of the child, would the high court have any favourable view on her case. Would it prefer reconciliation against my will/ wish?
