Legal Question in Family Law in India
Hi I got married on 14th Feb 2014 in Raipur at Gurudwara and the marriage was performed under Hindu Marriage Act. It is a second marriage for both me & my husband. My husband and his mother has cheated me and this matrimony came across through Sindhimatrimony.com.
He's a heavy drinker & chain smoker not ready to give up on these habits. He uses blows & fists and mentally, physically + sexually tortures me. He took away all my papers, education documents, previous decree etc and confined me a life hell than prison. He was too introvert not letting me move out alone any where not allowing use of mobile, internet.
He isn't working anywhere or has any business. He stated he was into Real Estate Business but doesn't provide any edivence.
He have learnt from outsiders that he has no income plus he's totally dependant on his mothers rental income from shops.
He states he will not let me work, nor provide me telecommunication, mass communication, nor open bank account, secure a future for me. Nor buy out any property.
Am staying in my parents house right now. My life has been ruined. I came back to my fathers house on 11th April and have made 2 FIRS against him i.e on 17th March & 10th April.
How to get this marriage dissoluted as early as possible. Coz its only 3 months to this marriage. I would like to get rid of this cheat in a neatful manner and dont want to drag it for years. Don't want anything out of this cheat but a mere divorce for his cruelty and humanitarian grounds.
Please advice procedure.
He isnt ready for mutual divorce and I think it can be filed only after 01 year of marriage.
Need your advice in this matter.

File Divorce case and /or Domestic violence case immediately.
