Legal Question in Family Law in India

I got married in 2006 and my wife was living in New delhi. She had breast cancer and same year her mother had breast cancer. Both completed treatment. I have 5 yr old son. There were lot of issues in between my wife and her inlaws who earlier lived at my home for treatment for nearly 4 years. But all treatement completed. Due best reasons she know she took my child and went to live with her parents in rajasthan. Due to job i relocated to chennai. I want to take child permantent custody as both the woman are cancer patients and keep the child with dem. I being in chennai now what should i do and which court to contact for custody of my son first and then proceed with divorce. please help.

Dear Sir,

For filing Divorce case it can be filed at the place where marriage took place or where both the parties last resided together therefore, you can file the Divorce case at Delhi only. Moreover, you can file for the custody of the child in the guardianship court.

You will need to file all cases concerned with your marriage and custody of the child at the place of jurisdiction where your wife is residing.

Advice & Caution: Litigation may prove to be very costly, time consuming, with uncertain results. If possible, try reconciliation with your wife and her family.
