Legal Question in Family Law in India

i got married 8 years back both of us had second innings .

my wife is living separately in hostel form last 8 months and doing job there also taken my 5 year old son .

now i want to go for sec 9 . her mother asking for 10 lacs against the out of court settlement & also not ready to give my son to me.
