Legal Question in Family Law in India

My mother in law took custody of my son when i was in prison becoz of murder my husband. After i came and ask my son she is nt willing to give my son. My son also said that he will cum after i prove that iam innocent. They offering me to give property of my husband like that. They mismercing my son. He is 11 years old. Can i put case for this and get my son in my custody. If my son says that he will not cum with me means what will d result cum?He should be in mother custody only know becoz he is minor...

And at what act i will file.?
