I am moving for a divorce.

I am married for 22 months.

My husband is a drunkard and illtreated me.

My husband deserted me 15 months back.

He is a software engineer working with IBM.

My father spent 40 laks for marriage.

Can I go for a mutual divorce and claim compensation?

If yes how far I can claim.

You may settle compensation mutually but it will be difficult for you to succeed for compensation in court if you just agree for a mutual divorce. Make settlement comprehensive and not in part. Compensation depends upon circumstances of each case. What were the circumstances under which you left and what are the evidence for that is crucial.

Yes you can go for a mutual divorce. Yes you can also ask for the compensation/one time alimony from your husband in the mutual divorce petition after having due negotiations with him.

mutual consent can only be filed when you have settled all your disputes with your husband for alimony, stridhan etc...and in case your husband does not agree for the stipulated amount, you may think of exhausting other legal remedies.

First you have to discuss with your husband coz if he agrees only then you can file mutual divorce and amount is to be settled mutually between you and your husband amicably.
