Hello, I am a muslim woman and 22 years old.I have a 5 years old girl baby.I was married 7 years ago.my husband and in law family always mentally tortured me.I couldn't coup up with them.last 3 years I am living with my parents without being divorced with her father.my cousin wants to marry me with my child.
if I want to marry my cousin and divorce her father how can I win my custody of my child? my cousin is doing a job in a bank.
my husband don't want to divorce me.

Thank you for your question. The law says the father is the natural guardian of a child. He will be responsible for the upbringing of the child. By virtue of being mother you can have the custody of your daughter until she attains puberty. After that your ex-husband will be entitled to get the custody of your daughter. I will say it will be difficult for you get custody of your daughter forever, however, you will have permission to see your daughter every now and then. In order to give permission of guardianship to anyone other than the natural father the court will always look into the matter of welfare and well-being of the child.
