Legal Question in Family Law in

I am an NRI, married in Jan'08. My wife has filed a 125 CrPc and RCR against me i India. As for the 125 CrPC order I am paying her an interim maintainence of Rs 7,500 per month. As against the RCR, I have filed for divorce. As part of the divorce proceedings, I am suppose to be present in court on the 7th of Dec'10. Can my wife file a 498A after this proceeding. Since I am an NRI, I am apprehensive about my passport being impounded, and future travel to my workplace.Please help!!!

one can file 498a at this stage even. But, since she has already filed RCR, you would gain on her filing 498A. Chances are good that you will get anticipatory bail and there will hardly be any question of passport or disturbance of future plan.
