My Question to Lawyers In Pakistan
I live in uk but am Pakistani National. I called my wife and two sons (current age 6.5 & 4.5) under my visa in aug 2010. She left me in Oct 2010 and started living with her Khala with two kids. I used to go and see my kids un till jan 2011. But suddenly she disappeared from that address.
My parents were continually trying for reconciliation but all the efforts went in vain.�
Later on January 2012 I came To know that she got prohibited step order, interim residence order, Non molestation orders against me and served these court orders on fictitious address. Obviously I was unable to attend court and Court made x party judgement. She also made her eligible for legal Aid.
My parents did not allow me to take immediate action against her and they spoke to her parents in Pakistan but result was big 0. Her parents said �now UK courts will decide.
I applied for contact order but appose and did put extreme nature of allegation on me. County court took this matter very seriously and after 2-3 case management hearings.
Where court listen my point of view and did allow me indirect contact via letters and gifts. Court also made an jurisdiction order so that no �body can take kids outside UK and�court called for Fact finding hearing for two days.
10-15 days before fact finding hearing my Solicitors wrote a letter to Her solicitors that if they need adjournment so let us know well in advance. They replied , their client is ready and not looking for adjournment.
On 1st day of court hearing mother requested court that she is not able to provide evidences today so please adjourn this hearing for 14 days. Judge was very keen to see evidences against me and adjourn hearing for another 5months.�
After two days of hearing she breach court order and took my kids to fly Pakistan.�
Now I did not see my kids from last2.5 years and she breach court order.
Please advice me what are appropriate steps do i need to take and what will be potential out come.

In Pakistan you can get visitation rights of children easily... U can also get the elder son's custody after 6 months... For UK i can refer u a solicitor who can guide u about the case.. For more do contact me at [email protected]

you may file a custody petition in pakistan , and right to visit your kids. breach of uk court's order can't be actionable here ... most you can do is show those order to frame your case favourable.
