Legal Question in Family Law in India
Hi im Seth Watson,
im a foreign citizen married to an indian citizen
we have been married for the past 14 years
we lived in my home country Kenya for 8 years and moved to India in 2007.
i faced many problems adjusting to India and generating and income for 3 years than in 2010 i managed to enter a line which generated an average income. now the work has grown and i am able to support the family.
i have a major problem with the woman i married even since the first night of out marriage.
i agree i also may have made some mistakes
being a foreigner the cultures in other countries are different and i had a child out of marriage before marrying my wife. so i thought it best to tell her as soon as possible but never got the require privacy to inform her before marriage. i also never informed her my father was a Hindu and mother was a Muslim since we were never brought up thinking it was a major issue.
so
on the first night of marriage i thought it be best to tell her and i guess that was the beginning of the whole problem.
she is very abusive and that comes from her family
any ways we have two kids now aged 13 and 9
we have been fighting since the beginning but thing have gotten worse in the last 5 months.
i most aggravated regarding the abusive language and have over 30 minutes of recorded audio of her abusing and insulting me and my family. im not abusive myself but this usually triggers me in to confrontations with her....
is there any laws which protect me from this or should i just pack my bags and head back home
the kids side her always and have threatened to kill me in my sleep on several occasions... i bear numerous scars on my body linked to them attacking me especially the elder boy. i also have photographic images
what should i do??

The litigation may be very tiring, expensive, prolonged. Results cannot be envisaged at this stage. You may make efforts for a mutual settlement. If that does not, return to your home country may be an option.
You can file a petition for divorce on the grounds of mental and physical cruelty. It is upto you to condone her cruel acts or seek legal help.
