Legal Question in Family Law in India

I shailesh h shah, aged 47 staying with wife & son. I am only looks towards my mother. My elder brother his wife & his son also staying with us. Totally we are 7 memmbers.The house is on `PAGDI' basis. Since last 10 years we have seperate kitchen under one roof. My elder brother & her wife is creating a lots of trouble to us. They are trying to keep us in their control by many ways. They humilate my wife in front of all our relatives. Their son is now young. They inspires him also to fight with us. Always they fights in big with us by creating small small reasons. many times elder brother told me to leave the house. The house is 1000 sq.ft. size.The house is on my mothers name. I want to crate a partition between two family or sale the house & get seperate, but my brother & his wife is not ready to do anything. It is not possible for us to stay together more with them. Can Family court help me in this matter?

Your mother only can do something.

As she is the tenant, she can ask your brother to go out of the house, you cannot do anything.
