Sir ,
Divorce petition filed by the husband dismissed by the Lower court and husband filed the First Appeal in high court and I received the copy of the same and found that
In the above First Appeal he has not filed any Affidavit but with the First Appeal he has filed a Stay Application and an affidavit in support of the Stay application clearly stating as under :-
AFFIDAVIT

CIVIL MISC. STAY APPLICATION NO. ���. OF 2014
IN
FIRT APPEAL NO��. ..OF 2014
Q 1 � Can the above affidavit be taken as affidavit with First Appeal OR Not ?
Q 2 � Can I request the Hon�ble Court to dismiss the First Appeal on the ground of filing without Affidavit ? Or
Q 3 � Can I request the Hon�ble Court to order it as Defective First Appeal on the ground of filing without Affidavit ?
