Legal Question in Family Law in India

Sir I have filled divorce case against my wife in September 2012, but as she got notice of it she lodge false Dowry and domestic violence complain against my whole family in march 2013 and made pressure to withdraw the divorce case but i cant live with her as her father n she her self put me dark and did not tell me that she is mentally ill and take medicines for that. Sir i was not at all happy with her and we only lived together for 3 months but i have a son with her.

Due to that pressure and to prevent the reputation of my parents i have written on affidavit that i will withdraw the divorce case so they have withdrawn the dowry and domestic violence and came with me in october 2013 and is with me but now am not withdrawing the divorce case as i cant accept her as they r fraud and m not getting any physical and mentally happiness frm her.

my question is that if i dont withdraw the case after that affidavit, is it punishable or what action can be taken against me.

If you had no intention to withdraw the divorce petition why file affidavit??Where was this affidavit filed. There is a child involved in this marriage. you wife may not be the best but your son is. please try to see the brighter side and rid yourself of the endless litigation. If you leave your wife the litigation will start afresh. the affidavit can be used against you in your divorce matter. for further query contact 9312411481
