Sir, my grand father had three sons and my father is second son,first son had expired and the last son has totally occupied the land.what is the legal procedures. Grand father has expired. And grand mother is live.the land is totally registered and done pattas under the name of grand mother and last son because grand mother is under that control of last son .last son has restricted my grand mother to meet my father .property valued 50 lakhs .

1) If the property is ancestral, even if ur grandfather registered in the name of grandmother and last son, ur father share cannot be alienated to the widow and third son.

2) If self-acquired, then ur grand father in turn the widow grand mother can bequeath as per her wish.
