Dear, you can file a suit for the custody of your daughter or you can file a petition for grant of rights of visitation of your daughter. there is much probability that you will be granted custody of your daughter and then you will not be liable for maintenance allowance. for more consultation you can call me on 0333-8081297 or email me on [email protected]
You have a strong case to get custody of your daughter. I don't know why custody was refused to you. It seems you have contracted second marriage and your mother-in-law might had claimed the custody while you failed to convince the court that welfare of your daughter lies in living with you (see Section 25(1) of Guardian and Ward Act, 1890). You may go into appeal and take custody of your daughter.
That said, please note it is your duty to provide maintenance expenditures to your daughter. She is your daughter and wherever she lives you are under legal duty to maintain her.

Move contempt petition... Custody of female child remains with mother unless
1. If she marries another man
2. If she is a lady of immoral character
3. The girl reaches the age of puberty.
