Divorce petition U/S 13 (1) (ia) oh HM Act 1955 filed by husband dismissed on 17.04.2014. He filed appeal in High Court. I was getting interim maintenance U/S 24 of HMA. which is closed with the judgement of the family court. Now I want to put up for maintenance U/S 125 CrPC, but my lawyer is telling I can not get maintenance more than 5000/- as per U.P. State amendment in CrPC. My husband is getting a gross salary of Rs 35000/-.

Q1-- Is my lawyer correct?

Q2-- What to do to get more interim maintenance ?

Q3--How much I can get the interim maintenance U/S 125 CrPC?

there is no upper limit in seeking maintrenance under sec 125 CRpc and UP is no exception.Please do file the petition under sec 125 CRPC. for further query contact at 9312411481.
