Legal Question in Family Law in India

sir/madam,

my cousin brother divorce case hearing start yesterday, after the counseling his wife is willing for a mutual divorce. she filed a fake 498a case against my brother and family but that case is in pending from 4 months , she is having another relationship so all her family members are with my brother, only her boyfriend is helping .

she need 1 lake Rs for mutual divorce. we don't like to spend 4 to 5 years for this case due to that we accept that settlement. but she is not willing to withdraw the 498a case.

if we go for a mutual divorce with out withdraw other case is there any legal problem for us in future?

the two cases are independant. Why are you paying 1 L just for divorce. try to make comprehensive settlement that she would not pursue her criminal case. Otherwise she would keep asking for money time and again.
