hello sir
my sister is suffering from 7 years in her married life by domestic violence and all and she had two children(boy) one of seven yesr old and other is three year old and the husband is a drunker. so how can she get the custody of both children.
she has qualified B.T.C & T.E.T exam & applying for govt. job. so can she get the custody of children in divorce.

1) When once u decide the marriage cannot be saved, file DV, 498A and 125 CrPC cases with full facts without delay. File also child custody case.
2) Never file divorce from ur side lest u may lose ur rights and benefits. Let the husband file if he wants.
3) Court will decide maintenance based on financial status of each spouse. What are all comforts the wife was enjoying at matrimonial as well parents home are continue to be given to her irrespective of whether the husband has income or not.
