Legal Question in Family Law in India
Hi my sister got married in 2009, just couple of days back she informed us that the marriage is not consummated, as when ever she asked her husband to start married life, he postponed saying he is not interested in kids. She waited for these many years and never told us about this considering it will breakdown all of us. Her sister-in-law has mentally tourchered her several times and her husband has never supported her rather he has supported his sister. She finally made her mind and told us the situation. She is not aware if her husband is impotent or not, and we are not sure he will accept for any medical tests. Now she has made her mind to separate from her husband.
Please let me know the course of action according to Hindu Marriage Law of India:
Should we go for annulment or MCD and 498a/DV, should we claim for compensation as we have spent 10-12 lakhs for the marriage (taking hand loans with huge interests, etc).
It would be of great help if you can guide us, so that it will help my sister to start her life a fresh...
