Legal Question in Family Law in India

my son in law has deserted his wife and four year old daughter. he is not in talking terms with any of us. my daughter wants to take indian passport for her minor child. the passport rules insist on the consent of both father and mother.her husband will not give the consent. how to tackle this problem legally?
